1. Acceptance of Terms
By downloading, installing, or using the Famello mobile application or website ("the Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.
If you are creating an account on behalf of a minor, you confirm that you are the parent or legal guardian of that minor and consent to these Terms on their behalf.
2. Eligibility
Adults: You must be at least 18 years old (or the age of majority in your jurisdiction) to create a parent account on Famello.
Children: Children may use Famello only through a child account created and supervised by a parent or guardian. Child accounts require verified parental consent in compliance with COPPA (for users in the United States) and applicable data protection laws.
3. Account Registration
To use Famello, you must create an account with accurate, current, and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access at support@famello.com
- Keeping your account information up to date
You may not share your account or allow others to access the Service through your account.
4. Acceptable Use
You agree to use Famello only for lawful purposes and in a way that does not infringe the rights of others. You must not:
- Use the Service to harass, abuse, or harm other users
- Upload or share illegal, harmful, or inappropriate content
- Attempt to gain unauthorised access to other accounts or systems
- Use automated tools to scrape, crawl, or access the Service
- Impersonate another person or entity
- Use the Service for commercial purposes without our written consent
- Violate any applicable laws or regulations
5. Family Groups & Content
Famello enables family communication within private, closed groups. By using family communication features, you acknowledge:
- Parents are responsible for supervising their children's use of the Service
- You own the content you create within your family group
- You grant Famello a limited licence to store and transmit your content solely to provide the Service
- You must not share content that is illegal, harmful, or violates these Terms
6. Subscription & Payment
Free tier: Famello offers a free version with core features included.
Premium subscription: Optional premium features are available via a paid subscription. Subscriptions are billed monthly or annually as selected and are managed through the Apple App Store or Google Play Store.
Cancellation: You may cancel your subscription at any time through your device's app store settings. Access to premium features continues until the end of the current billing period.
Refunds: Refund requests are subject to the policies of the Apple App Store or Google Play Store.
7. Intellectual Property
All intellectual property in the Famello application, website, brand, and content (excluding user-generated content) belongs to Famello. You may not reproduce, distribute, or create derivative works without our express written permission.
The Famello name, logo, and product identity are trademarks of Famello. Nothing in these Terms grants you the right to use our trademarks.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Famello, you consent to our collection and use of data as described in the Privacy Policy.
9. Service Availability
We aim to provide a reliable service but cannot guarantee uninterrupted access. We may:
- Perform scheduled or emergency maintenance
- Update or modify the Service at any time
- Discontinue features with reasonable notice
We are not liable for any losses resulting from service interruptions outside our reasonable control.
10. Limitation of Liability
To the maximum extent permitted by law, Famello shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of data, profits, or business opportunities
- Damages resulting from your use or inability to use the Service
Our total liability to you shall not exceed the amount paid by you in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your account if you violate these Terms or engage in behaviour that is harmful to other users or to the Service. You may delete your account at any time through the app settings or by contacting us.
Upon termination, your data will be handled in accordance with our Privacy Policy.
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before changes take effect. Continued use of the Service after the effective date constitutes acceptance.
